2. Terms of Service
2.1 Acceptance of Terms
By accessing or using oricert.com, purchasing an Oricert Trusted Seal, or receiving a Certificate of Authenticity, you (“User,” “seller,” “buyer,” or “overifier”) agree to be bound by these Terms of Service. If you do not agree, you may not use the platform.
If you are using the platform on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.
2.2 The Oricert Service
Oricert provides the following core services:
- Issuance of Oricert Trusted Seals — cryptographic certificates anchored on the Polygon PoS blockchain
- Public verification pages accessible to any person via URL or QR code scan
- Encrypted off-chain storage of item evidence (photos, descriptions, provenance)
- Certificate PDF generation and delivery
- Ownership transfer recording on-chain
- Oricert Micro services for microfinance markets (Phase 4 — availability varies by region)
2.3 Seller Responsibilities
As a seller issuing an Oricert Trusted Seal, you represent and warrant that:
- You are the legal owner of the item being certified, or have explicit authority from the owner to certify it
- All information you submit — including item description, condition, provenance, and photos — is true, accurate, and complete to the best of your knowledge
- You are not using Oricert to certify counterfeit goods, stolen property, or items obtained through fraud
- You understand that the certificate hash is anchored permanently on a public blockchain and cannot be altered or deleted
- You have the right to share any photos or documents you upload, and doing so does not infringe any third-party copyright or privacy rights
Warning
2.4 Blockchain Immutability Notice
You expressly acknowledge and agree that:
- Once a seal is issued, the SHA-256 cryptographic hash of your certificate is permanently recorded on the Polygon proof-of-stake blockchain
- This on-chain record cannot be modified, overwritten, or deleted by Oricert, by you, or by any third party
- The deletion of your personal data from Oricert’s off-chain systems (as described in this Privacy Policy) will render the on-chain hash a disconnected cryptographic string with no linkage to your identity — it will remain on the blockchain but will reference no personal information
- Oricert is not responsible for the actions, failures, or downtime of the Polygon network, Alchemy RPC nodes, or any third-party blockchain infrastructure
2.5 Payment Terms
All payments are processed by Stripe, Inc., a third-party payment processor. Oricert does not collect, store, or have access to your payment card information at any time. By making a payment, you also agree to Stripe’s Terms of Service and Privacy Policy.
Seal issuance fees are non-refundable once a seal has been anchored on the blockchain. If a technical failure prevents anchoring, Oricert will either re-issue the seal at no additional charge or provide a full refund.
Current pricing: USD $69 per single seal; USD $149/month for Power Seller subscription. Oricert reserves the right to modify pricing with 30 days’ notice to existing subscribers.
2.6 Intellectual Property
The Oricert name, logo, seal design, certificate design, platform interface, and all associated intellectual property are owned by Oricert Group, Inc. and are protected by US and international intellectual property law.
You retain all intellectual property rights in the photos and descriptions you submit. By uploading them to Oricert, you grant Oricert a limited, non-exclusive license to store, display, and reproduce that content solely for the purpose of operating the verification service and generating your certificate.
2.7 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ORICERT, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF ORICERT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Oricert’s total cumulative liability to you for any claims arising from or relating to the service shall not exceed the greater of (i) the amount you paid to Oricert in the 12 months preceding the claim, or (ii) USD $100.
Oricert does not guarantee the market value or resale value of any certified item. Appraisal values displayed on certificates are seller-provided and do not constitute an appraisal by Oricert.
2.8 Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising from these Terms shall be subject to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, with proceedings conducted in Dallas County, Texas.
You waive any right to participate in a class action lawsuit or class-wide arbitration against Oricert. Claims must be brought individually.
2.9 Modifications to Terms
Oricert reserves the right to modify these Terms at any time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the platform after the effective date constitutes acceptance of the revised Terms.
3. User Consent Statement
At the time of purchasing an Oricert Trusted Seal, you will be asked to affirmatively check a box confirming the following consent statement. This consent is a prerequisite to seal issuance and is recorded with a timestamp and IP address hash.
Consent Statement
By checking the consent box at checkout, you agree to the following statement:
“I consent to Oricert storing my name, email, and item details to issue and maintain this certificate. I understand my photos are stored encrypted on AWS. I can request deletion at any time.”
This consent is recorded with a timestamp and IP address hash at the time of payment. You may withdraw this consent at any time by submitting a deletion request to privacy@oricert.com.
3.1 Consent Withdrawal
You may withdraw this consent at any time by submitting a written deletion request to privacy@oricert.com. Withdrawal of consent will result in deletion of your personal data from Oricert’s off-chain systems as described in Section 6 of this Policy. Withdrawal does not affect the lawfulness of processing that occurred before withdrawal, and does not remove the anonymous cryptographic hash from the Polygon blockchain.
